CLICK BOX TO ACCEPT Eligibility Requirements: 1. You must apply as a team to season thirteen of The Amazing Race Canada (the “Race”) with one (1) other person. You and your teammate consist of the team (“Team”). If your Team is selected by the Producer (defined below) for an interview for the Race, you both must be willing to travel at your own expense to be interviewed at a time to be scheduled by the Producer in its sole discretion. 2. Your Team must be available and willing to participate in the Race for a period of approximately thirty-five (35) days, on such dates to be determined by Producer in its sole discretion, with the other Teams. If your Team is chosen to participate in the Race, it is your responsibility to make any necessary personal and financial arrangements with your employers and family in anticipation of your extended absence from work and home. 3. The Race will consist of a number of physical and mental challenges that may involve twists of plot and elements of surprise. If your Team is chosen to participate in the Race, both you and your teammate will be videotaped, filmed, portrayed, photographed and otherwise have recordings of you and your actions broadcast and exploited throughout the duration of the Race and broadcast and exploited in perpetuity in any language, manner, communication, and/or media whatsoever, in all forms whether current or developed in future (whether or not foreseeable), at the sole discretion of the Producer. 4. Your Team must be willing and legally be able to travel within Canada and around the world and having no restrictions on travel to any territory, state, province, and country in the world, on such dates and at such locations as Producer shall designate in its sole discretion. 5. One Team will have the chance to win a cash prize and/or other such prizes (“Prize(s)”) as may be available in Producer and/or Broadcaster’s (defined below) discretion. Prizes will not be awarded until after the broadcast of the final episode of the show and in accordance with the procedures established by Producer in its sole discretion. 6. You and your teammate must be nineteen (19) years of age by April 1, 2027. 7. You and your teammate must be a Canadian citizen or permanent resident of Canada. 8. You or your teammate must possess a valid Canadian driver’s license by March 1, 2027 that is valid for at least six (6) months from that date. 9. You and your teammate must each possess a valid Canadian passport or a Canadian permanent resident card and a valid passport by March 1, 2027 that is valid for at least six (6) months from that date and that does not have any travel restrictions. 10. You and your teammate must be in good health and be able to withstand the physical and mental rigors of the Race. 11. If your Team is selected to be interviewed, you may be given, and must complete and return, any further application materials (including, but not limited to, medical history forms, psychological and health questionnaires), or submit further documentation as may be required by Producer in its sole discretion for purposes of determining if your Team is physically and mentally capable of completing the Race, for casting, and other such similar decisions in connection with your Team’s application to the Race. 12. If selected as a semi-finalist for the casting selection process of the Race, both you and your Teammate must complete the Participant Form Package, which will be furnished to you by the Producer which will include, but is not limited to: Participant Agreement & Release, psychological and medical assessments, Confidentiality Agreement (including those for your immediate family members), Caretaker Agreement and other additional information as required by Producer. You must also submit to physical and psychological examinations by medical professional(s) selected by the Producer and meet all physical and psychological requirements. 13. By applying to participate in the Race, you authorize the Producer to conduct civil, criminal, financial, driver-history and any other types of background checks deemed necessary by the Producer. 14. Employees, officers, directors and agents of Bell Media Inc. (“Broadcaster”), Best Adventure Productions 13 Inc. (“Producer”), Insight Productions Ltd., Buena Vista Television, Profiles Television Productions LLC, any sponsor of the Race, and/or any of their respective licensees, assigns, parents, affiliated and subsidiary companies and the immediate family (spouse, mother, father, sister, brother, daughter or son, regardless of where they live) or members of their same households (whether related or not) of such employees, officers, directors and agents are not eligible to be participants on The Amazing Race Canada or participate in the application process. Additionally, Producer and Broadcaster reserve the right to render ineligible any person who either of them determines, in either’s sole discretion, is sufficiently connected with the production or distribution of The Amazing Race Canada (including, through a connection to any sponsor of The Amazing Race Canada or a contest or prize related thereto), such that his/her participation in The Amazing Race Canada could result in or create the appearance of impropriety. During the casting process, applicant Teams will be chosen by the Producer in its sole discretion to create a pool of finalist Teams. The Producer reserves the right to change any of the application terms and process at any time or to select or not select anyone at its sole discretion. The Producer is looking for a dynamic group of Teams who are articulate, interesting and exhibit enthusiasm for the Race. In addition, the Producer is looking for Teams that are outgoing and adventurous. You and your teammate must have a strong personal connection. You must be willing to exert yourself in the face of mental and physical challenges, detours, roadblocks, faceoffs and other obstacles that will be found in and around the Race. The group of Teams, while meeting the technical requirements of the program, must also have sufficient emotional, physical and psychological capacity to endure approximately thirty-five (35) days in any number of conditions, environments and climates. Application Instructions: Applicants MUST go to http://amazingracecanadacasting.ca to fill out an Online Application, agree to the Online Agreement and Release and submit photographs and a video. Please take note to follow all instructions on the website and carefully review the following: • Bell Media Inc.’s Privacy Policy (located at https://www.bell.ca/Security_and_privacy/Commitment_to_privacy) which applies to the collection, use and disclosure of your personal information during the application process; • Online Agreement and Release (located at https://theamazingracecanadaseason13.castingcrane.com/) which has important information about your participation in the application process and if selected, in the Race; • Blue Ant Media Corporation’s Production Privacy Policy (attached hereto as Exhibit “A”), which applies (along with the online Privacy Policy, located at https://blueantmedia.com/privacy-policy/ ) to the collection, use and disclosure of your personal information. Deadline: The application deadline at this time is December 7, 2026, at 11:59 p.m. PT, but may be changed at any time. All materials you send us (including videotape and photos) will be retained by the Producer and will become the property of the Producer and will not be returned to you. See Online Release and Waiver for further details. Any expenses you incur during the application process including postage, internet usage, shipping and materials preparation (videotape, photos, etc.) are your sole responsibility. Producer will not reimburse you for these expenses. All decisions of the Producer are final and absolute and not subject to inquiry or challenge. If you have successfully completed the Online Application, you will receive an automatic email notification, however, Producer will be unable to respond to any inquiries about your status as an applicant. If your Team is selected for an interview, you will be advised by the Producer shortly before the interview is scheduled. If your Team is selected to participate in the final selection process, you will be so advised by the Producer shortly before the final selection process is scheduled. Producer reserves the right to change the terms of the application and the production schedule at any time. Producer reserves the right to change the eligibility requirements and any other application rules in its sole discretion at any time with or without notice on a specific, case-by-case basis or across the entire application pool. Producer also reserves the right to not hold any participant applicant interviews, or to modify the manner in which it conducts participant applicant interviews, or to not produce the thirteenth season of The Amazing Race Canada at all. This Production Privacy Policy (the “Policy”) governs the collection, use and disclosure of your Personal Information in all communication or interactions you may have with us, including interactions that occur in person, over the telephone, in writing, or electronically, or through Company’s production, casting or business operations. Company complies with all of the requirements of Canada’s privacy legislation, the Personal Information Protection and Electronic Documents Act and substantially similar provincial legislation. By submitting your Personal Information to Company in the course of any communication or interactions you may have with us or through Company’s production, casting or business operations, you accept this Policy and consent to its terms and any other terms described to you at the time of collection of your Personal Information. For clarity, this Policy does not apply to your use of Company’s website(s), which is instead governed by the Blue Ant Media Corporation Website Privacy Policy (https://blueantmedia.com/privacy-policy/). POLICY AMENDMENTS This Policy may be modified, revised or updated at Company’s discretion, at any time, without notice to you. When we make changes to this Privacy Policy we will revise the “Last Updated” date at the top of the Policy. Please check back from time to time for such amendments. If we would like to use your previously collected Personal Information for different purposes than originally specified in this Policy at the time of collection, we will provide you with notice and, where required by law, seek your consent before using your Personal Information for a new or unrelated purpose. WHAT IS PERSONAL INFORMATION? “Personal Information” is information about an identifiable individual, including your name, age, residential address and e-mail address, credit card and billing information, your views and personal opinions, and you health information and medical records. Publicly available information, such as business contact information or a public directory listing of your name, address, telephone number or information that is aggregated and not associated with a specific individual, including demographic information and statistics, or anonymous information is not considered Personal Information. WHAT PERSONAL INFORMATION WILL COMPANY COLLECT? We will only request Personal Information from you that is necessary to establish, manage and maintain our relationship with you. Personal Information is collected by Company when you provide it to us, such as, when you fill out an application to participate, or otherwise participate in one of our productions, contact us via email or call us. We may also receive Personal Information from our business partners and other third parties, provided that such third parties confirm to us that they have obtained your consent or we have obtained your consent in this regard. HOW WILL COMPANY USE THE INFORMATION WE COLLECT? Company collects, uses and discloses your Personal Information for the following purposes: • to contact and correspond with you; • to make casting decisions; • in connection with your participation, or potential participation, in Company productions or programs and related development, production, post-production, distribution, exhibition and promotional activities; • to respond to your communications and requests; • if you enter a contest or other promotion offered by Company, we may, under the rules of the promotion, use your name and certain other information to administer the promotion, such as contacting, announcing and promoting the winners of the promotion; • to meet legal, regulatory, audit, security and financial requirements under federal and provincial regulations; • to maintain business records for reasonable periods of time; • to conduct market research and gather demographic and statistical information about our users, for managing our business; and • at your option, to make you aware of Company projects that may be of interest to you. Also, you may indicate that you are interested in receiving information from Company. If so, your Personal Information will be used to contact you or to send you e-mail materials and other mailings about productions or projects that might be of interest to you. You may choose to unsubscribe at any time. In addition, you always have the option to tell us not to share your Personal Information with third parties. HOW WILL COMPANY DISCLOSE THE INFORMATION WE COLLECT? Company does not trade or sell Personal Information to others. As described in greater detail below, Company may generally disclose Personal Information to respond to legal requirements, enforce our policies, respond to claims that content violates the rights of others, or protect anyone’s rights, property, or safety. Such information will be disclosed in accordance with applicable laws and regulations. Limited disclosure of Personal Information to third party service providers (“Third Party Service Providers”) may be required as part of Company fulfilling its stated business duties and day-to-day operations. However, information will only be disclosed to such Third Party Service Providers if they have entered into a written agreement with us to abide by this Policy. We will limit this disclosure to only the Personal Information that is reasonably necessary for the purpose or service for which the Third Party Service Provider is engaged. We will use contractual and other means to provide a comparable level of protection while the information is being processed by these Third Party Service Providers, including limiting such providers to using your Personal Information solely to provide Company with the specific service for which they were engaged, and for no other purpose. We may be involved in the sale or transfer of some or all of our businesses. As part of that sale or transfer transaction, we may disclose your Personal Information to the acquiring organization, but will require the acquiring organization to agree to protect the privacy of your Personal Information in a manner that is consistent with the Policy. We may share your Personal Information with law enforcement, national security agencies or other governmental officials, as required or permitted by law, such as in response to a court order or a verified request relating to a criminal investigation or alleged illegal activity. PROCESSING, RETENTION AND STORAGE OF PERSONAL INFORMATION We will retain your Personal Information for only so long as is necessary to fulfil the purposes for which it was collected, and for such periods of time as may be required to comply with applicable law. When your Personal Information is no longer required, we will make all reasonable efforts to ensure all electronic and hard copies of such information are securely destroyed and irreversibly deleted from our systems. SECURITY We take all reasonable measures designed to safeguard your Personal Information against unauthorized access, use, disclosure, copying or modification. Such measures, which may necessarily evolve over time as the availability and effectiveness of methods vary, include physical, organizational and technological safeguards, such as: • restricting access to Personal Information to employees and Third Party Service Providers who need such information for a legitimate business purpose, and who are required to abide by this Privacy Policy and Company’s internal privacy and security practices; • restricting access to our systems, accounts and electronic databases or other electronic formats that may contain Personal Information through password protection and internal security policies; and • implementing technical security measures such as firewall technology, anti-malware screening and data encryption technology. While Company employs security measures, you should be aware that there is a residual risk in transmitting any data electronically. Despite our efforts, no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other type of misuse. This risk is inherent in all Internet dealings. HOW TO CORRECT YOUR PERSONAL INFORMATION Company wants to ensure that information about you is accurate, complete and current. Please inform Company of any change of name, address or other information. In addition, you have the right to access the Personal Information that Company has collected, stored, and disclosed about you, subject to any legal restrictions. If there are errors in the information in your files, you may request that it be changed. If we have disclosed inaccurate information about you to a third party, we will be pleased to contact the third party in order to advise them of the error. In order to access this information, you must put your request in writing to our DPO as set out below. (the “Producer”) considering me and my teammate as participants for season thirteen of the television program currently entitled “The Amazing Race Canada” (the “Program”) and by agreeing and acknowledging in the Online Application that I have read and understand the Online Application (which includes, without limitation, the eligibility requirements) and this Online Agreement and Release (collectively, the “Application”), I represent, warrant and agree as follows: 1. I acknowledge that: (i) I have read, understand, am satisfied and agree to be bound by the eligibility requirements set forth in this Application; (ii) I have answered the questions in this Application honestly, accurately and completely; (iii) if any of the information in this Application is found to be false or incomplete, this will be grounds for dismissal from the participant selection process and/or from the Program, if selected, and may also result in the forfeiture of any prizes or other items I may have been awarded (whether or not I have already received them); (iv) even if I meet the eligibility requirements set forth herein, Producer has no obligation to interview me and/or select me as a participant; (v) I agree to keep strictly confidential all information about the Program that I acquire during the participant selection process and/or my participation in the Program; (vi) my voice, action, and likeness may be recorded as a part of this Application and participant selection process and I understand that Producer may, but is in no way obligated to, use such recordings within the Program and all related productions and publicity or in any other manner at the discretion of Producer, whether or not I am selected as a participant in the Program; (vii) even if I am selected as a participant, Producer has no obligation to produce the Program or conduct the competition and Bell Media Inc. (the “Broadcaster”) has no obligation to exhibit it, even if conducted and produced; (viii) all decisions by Producer concerning selection of the participants are final and not subject to challenge or appeal; and (ix) Producer has no obligation to return any materials (including the photographs, video submission and written materials) (collectively, the “Materials”) provided by me to Producer’s representatives at any time in connection with the Application, the participant selection process, and/or the Program, whether or not I am selected as a participant, and Producer may, but is in no way obligated to, use any such Materials or Recordings (defined below) in the Program or in any other manner as set out herein. I warrant and represent that I have all right and authority to grant the rights in the Materials and the Recordings to the Producer as contemplated herein; and I shall not give or agree to give any member of the production staff and anyone associated in any manner with the Program, or any representative of the Producer or Broadcaster any compensation or anything else of value to arrange my appearance on the Program or to accept or agree to accept anything of value to promote any product, service or venture on the Program, or use any prepared material containing such a promotion. 2. I hereby consent to the production, reproduction, broadcast, publication, exhibition, distribution, adaptation, recording, use and reuse by Producer, Broadcaster, Buena Vista Television, Profiles Television Productions LLC, and their respective licensees, successors, assignees, parents, subsidiaries, or affiliated entities and each of the respective employees, agents, officers and directors of the foregoing entities (collectively, the “Releasees”) of my voice, actions, likeness, name, appearance, biographical material (collectively, “Likeness”), and any information contained or derived from my Application, including, without limitation, any other video, recordings or still pictures of me taken during the participant selection process (collectively, the “Recordings”) and/or contained in any Materials submitted by me in connection with my Application, including any audition tape, as such Likeness may be edited, altered, or modified by Releasees, in any and all media now known or hereafter devised, throughout the universe in perpetuity (“Media”), in or in connection with the Program and all related productions, publicity material, spin-offs, advertising or any other production. I agree that the Releasees may use all or any part of my Likeness and may alter or modify it regardless of whether or not I am recognizable. I further grant irrevocably to, fully assign, and agree that the Releasees shall own exclusively any and all right, title, and interest (including, without limitation, all copyrights) in and to the Materials and all Recordings and any other materials that I have provided or may provide in connection with this Application, the Program and the participant selection process and in and to any video, recordings or still pictures taken during the participant selection process of any such materials provided by me, and acknowledge and agree that the Releasees may, in their sole and unfettered discretion, edit, alter or modify, and use all or part of the all such Materials and Recordings and my Likeness in all Media. I represent and warrant (i) that everyone appearing in the Materials and Recordings (including but not limited to my teammate who has read and understands all the elements of the Application and has authorized me to submit his/her personal information and all the Materials and Recordings on his/her behalf as part of this Application) and anyone who may have shot or created such Materials and/or Recordings agrees that they may be used, as edited, altered or modified by Producer or by any of the other Releasees, in all Media without any compensation, (ii) the Materials and Recordings will be free from any material that is libelous, defamatory, profane, obscene, pornographic or graphically violent, and will not contain any content that is contrary to law or which places any of the participants appearing on or off camera at serious risk or harm, and (iii) that I have the rights and licenses necessary to submit the Materials and Recordings and grant all of the rights granted herein. I hereby expressly waive in favour of the Producer, any moral rights that I may have with respect to the audio-visual productions and/or sound recordings produced and/or recorded in the Materials, the Recordings, or otherwise for the purposes of the Program. I grant the rights hereunder whether or not I am selected to participate in the Program in any manner whatsoever. I understand that I will not be paid any money for giving Releasees these rights, or for submitting the Application, the sole consideration for which being the Producer’s consideration of me as a possible participant in the Program, which I acknowledge is good, valuable and sufficient. 3. I agree to take any further action, in writing (including, without limitation, confidentiality agreement, execution of affidavits, assignments, and/or other documents), reasonably requested by Producer to effect, perfect or confirm Producer’s and Broadcaster’s rights in the Materials, the Recordings and my Likeness or otherwise in connection with this Application. 4. I understand that the participant selection process will involve subjective decisions made by the Producer and/or Broadcaster, or those authorized on their behalf, in their sole discretion, (collectively, the “Panelists”). I understand that the Panelists may make casting recommendations to the Producer and the Broadcaster but that all casting decisions will be made by the Producer and the Broadcaster in their sole discretion. I further understand that the Panelists, the Broadcaster, Producer and/or other persons or entities may be acquainted with or have some familiarity with some or all of the applicants to varying degrees. I understand and agree that all participant selection and elimination decisions shall be final and binding on me in all respects, and shall not be subject to challenge or appeal. 5. I hereby release the Releasees as well as any television station or channel, cable network, satellite network or any digital platform that exhibits the Program, the Materials, or the Recordings, the other participants in the Program, the advertisers and promotional agencies connected with the Program, all other persons and entities connected with the Program, each of the respective parent, subsidiary and affiliated companies of the foregoing, and each of their respective officers, directors, agents, representatives, employees, successors, assignees, and licensees (collectively, the “Released Parties”) from any and all claims, actions, damages, liabilities, losses, costs and expenses of any kind (including, without limitation, legal fees) arising out of, resulting from, or by reason of, the Materials, the Recordings or my participation in or in connection with the Program, including, without limitation, my participation in the participant selection process of the Program, participation in any Program related activities, any exploitation of the Program or my appearance on the Program, the failure of Producer to select me as a participant, the cancellation of the Program, any activities in connection with the video submission, or the exercise by Producer of any rights granted by me with respect to the Program on any legal theory whatsoever (including, but not limited to, personal injury, rights of privacy and publicity, false light, and defamation) (the “Released Claims”). The Released Claims specifically include, without limitation, any and all claims, actions, damages, liabilities, losses, costs and expenses (including legal fees) of any kind resulting from the actions of another participant or any other third party at any time. 6. With respect to the information provided by me in this Application, (both individually and on behalf of my teammate) including but not limited to all “personal information” collected by Producer and/or or its authorized agents pursuant to the terms hereof: (a) I authorize Producer and/or its authorized agents to investigate, access and collect information about me, about any of the statements made by me in my Application, any supporting documents and any other document that I have signed or do sign in connection with my Application to be selected as a participant in the Program, or any other written or oral statements I make in connection therewith. I irrevocably authorize Producer and/or its authorized agents to secure information about my experiences from my current and former employers, associates, friends, family members, educational institutions, government agencies, credit reporting agencies, and any references I have provided, and I irrevocably authorize such parties to provide information concerning me. In the course of these investigations, I agree that Producer and/or its authorized agents may disclose to the foregoing entities personal information that I have provided in this Application or that Producer has obtained from third parties, if Producer determines, in its sole discretion, that disclosure to a third party is necessary in the course of the investigation. I specifically authorize investigation of my employment record and government records, including, but not limited to, my motor vehicle records, civil or criminal record, credit and/or consumer report(s). (b) I hereby authorize Producer to conduct psychological and physical examinations and background investigations of me if required by Producer in Producer’s sole discretion. I further authorize the individuals conducting such examinations and investigations of me to disclose to Producer and to Producer’s representatives all information about me obtained in connection with such examinations or investigations. Additionally, or in the alternative (in Producer’s sole discretion), I will provide Producer with certification from my personal physician stating that I am physically fit and have no medical condition that would prevent me from participating in the Program, and that engaging in the Program would not endanger my health in any way or give rise to any medical condition or exacerbate any medical condition I may have. (c) I acknowledge and agree that any such information obtained by Producer pursuant to this section 6, this Application or otherwise may be used for the purpose of making casting and other similar decisions for the production (and public viewing) of the Program, and, with the exception of medical information, may be described, disclosed or otherwise used in and in connection with the Program, any subsequent seasons of the Program, and any ancillary or related productions, including “making-of” and “behind-the-scenes” productions, and/or for publicity and promotional purposes related thereto. (d) I hereby unconditionally and irrevocably release and forever discharge the Released Parties and all such parties and persons from any and all liabilities arising out of or in connection with any such investigations and arising out of the collection, use and disclosure of my personal information in the ways stated in this Application and agree not to make any claim against Released Parties in respect of such use (including, without limitation, any claim that such use invades any right of privacy and/or publicity and any claims based on defamation or false light). 7. I acknowledge, represent and warrant I am not an employee, officer, director or agent of the Broadcaster, the Producer, Insight Productions Ltd., Buena Vista Television, Profiles Television Productions LLC, any known sponsor of the Program and/or any of their respective licensees, assigns, parents, affiliated and subsidiary companies or the immediate family (spouse, mother, father, sister, brother, daughter or son, regardless of where they live) or members of their same households (whether related or not) of such employees, officers, directors or agents. I further acknowledge and agree that each of Producer and Broadcaster have the right to render ineligible any person who either of them determines, in either’s sole discretion, is sufficiently connected with the Program (including, through a connection to any sponsor of the Program or a contest or prize related thereto), such that his/her participation in Program could result in or create the appearance of impropriety. 8. Whether or not I am selected to be a participant on the Program, I shall keep in strictest confidence and shall not disclose to any other applicant, participant or other third party at any time (i.e. prior to, during, or after the taping or exhibition of any episode of the Program) any information or materials of any kind, including without limitation, any information or materials concerning or relating to Producer or to Broadcaster, the business of Producer or Broadcaster, any program produced by Producer and/or exhibited by Broadcaster, including, without limitation, any information concerning or relating to the Program, the Program applicants, the Program participants, the location(s) of the Program, the events contained in the Program, or the outcome of any contest in or episode of the Program, that I read, hear or otherwise acquire or learn in connection with or as a result of my applying to be a participant on the Program or (if I am selected to be a participant) as the result of my experiences as a participant on the Program (collectively, the “Information and Materials”). I acknowledge and agree that the Information and Materials are confidential and the exclusive property of Producer and/or Broadcaster. At no time will I ever, directly or indirectly, divulge in any manner or use or permit others to use any of the Information and Materials. 9. I acknowledge that in the event I breach the confidentiality or any other provisions of this Application, my breach may, in the sole discretion of Producer and/or Broadcaster, result in my being disqualified to participate as a participant in the Program. I further acknowledge that a breach by me of any of the confidentiality provisions of this Application would cause Producer and Broadcaster irreparable injury and damage that cannot be reasonably or adequately compensated by damages in an action at law, and, therefore, I hereby expressly agree that Producer and Broadcaster shall be entitled to injunctive and other equitable relief to prevent and/or cure any breach or threatened breach of any of the confidentiality provisions of this Application by me. I also recognize that proof of damages suffered by Producer and Broadcaster in the event that I breach any of the confidentiality provisions of this Application will be costly, difficult, and/or inconvenient. Accordingly, I agree to pay Producer and Broadcaster the sum of One Million Canadian Dollars (CDN$1,000,000.00) per breach plus disgorgement of any income that I may receive in connection with my breach as liquidated damages in the event I breach any of the confidentiality provisions of this Application prior to the initial public exhibition of the final episode of the Program. I agree that One Million Canadian Dollars (CDN$1,000,000.00) plus disgorgement of any income that I may receive in connection with my breach is a reasonable estimate of the amount of damages Producer and Broadcaster are likely to suffer in the event I breach any of the confidentiality provisions of this Application prior to the initial public exhibition of the final episode of the Program, considering all of the circumstances existing as of the date of this Application. In addition, I agree to pay Producer and Broadcaster the sum of One Hundred Thousand Canadian Dollars (CDN$100,000.00) per breach plus disgorgement of any income that results from my breach as liquidated damages in the event I breach any of the confidentiality provisions of this Application after the initial public exhibition of the final episode of the Program. I agree that One Hundred Thousand Canadian Dollars (CDN$100,000.00) plus disgorgement of any income is a reasonable estimate of the amount of damages Producer and Broadcaster are likely to suffer in the event I breach any of the confidentiality provisions of this Application after the initial public exhibition of the final episode of the Program, considering all of the circumstances existing as of the date of this Application. 10. I acknowledge that (i) the provisions of this Application shall enure to the benefit of the successors and assigns of Released Parties and shall be binding upon my heirs, executors, administrators and representatives, (ii) this Application will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein and that the courts of Ontario will have exclusive jurisdiction over any matter arising out of this Application, (iii) if any provision of the Application is invalid, illegal, or unenforceable in any jurisdiction it will, as to that jurisdiction be ineffective only to the extent of such invalidity, illegality or unenforceability, without affecting in any way the remaining provisions hereof in such jurisdiction or rendering that or any other provision of this Application is invalid, illegal or unenforceable in any other jurisdiction, and (iv) that Releasees may freely assign, in whole or in part, any of their rights or obligations under the Application and I may not assign my rights and obligations under this Application. 11. I acknowledge and agree that Producer and/or Broadcaster reserves the right to change the terms and conditions of this Online Agreement and Release, the Online Application, Bell Media Inc.’s Privacy Policy, and Blue Ant Media Corporation’s Privacy Policy and Blue Ant Media Corporation’s Production Privacy Policy at any time without any notice to me. PLEASE NOTE: All personal information (i.e., information about an identifiable individual including but not limited to personal health information) that I provide to the Producer/Releasees or consent to the collection, use or disclosure of by the Producer/Releasees pursuant to this Online Agreement and Release will be dealt with in accordance with (as applicable): (i) this Online Agreement and Release;; (ii) Bell Media Inc.’s Privacy Policy (located at https://www.bell.ca/Security_and_privacy/Commitment_to_privacy) during the application process; (iii) Blue Ant Media Corporation’s Privacy Policy (available through the following link: https://blueantmedia.com/privacy-policy/); (iv) the Production Privacy Policy (attached hereto as Exhibit “A”); and (v) applicable privacy legislation. By signing this Online Agreement and Release, I hereby provide express consent to Producer and/or Releasees for the collection, use and disclosure of such personal information in accordance with the foregoing. I also provide express consent for the Producer and/or Releasees to reproduce and incorporate any personal information included in the Materials and Recordings in and in connection with the production and public exhibition of the Program, any subsequent seasons of the Program, and any ancillary or related productions, including but not limited to “making-of” and “behind-the-scenes” productions, in any manner or media whatsoever, and/or for all publicity and promotional purposes related thereto, without restriction. Notwithstanding the foregoing, all personal information acquired through any medical, blood and/or urine testing for (as applicable) COVID-19, drugs, sexually transmitted infections and background investigations as permitted herein will be used solely for the purpose of making casting and other similar decisions, determining my fitness to participate in the Program and to ensure the health and safety of those associated with the Program. If there are errors in the information in your files, you may request that it be changed. If we have disclosed inaccurate information about you to a third party, we will be pleased to contact the third party in order to advise them of the error.
